Attendee Terms & Conditions

Overview

These terms and conditions are entered into by and between Ververica GmbH, located at Chausseestraße 20, Berlin 10115, Germany ("Ververica", "we", "us" and "our") and each person ("you") who register for or in attendance of the Flink Forward Berlin 2024 Conference (the "Event") organized by Ververica (the "Event Terms").

By registering for or attending the Event, you agree:

• to be bound by and fully accept these Event Terms;
• to comply fully with all posted instructions onsite and the instructions from our personnel at the Event.

If you are not authorized or do not agree to any of these Event Terms, you must not register for and attend the Event.

You further agree that you understand and will comply with the following terms and conditions and policies which are incorporated by reference to these Event Terms:

• Flink Forward’s Code of Conduct (found at https://www.flink-forward.org/berlin-2024/code-of-conduct);
• Event Privacy Policy https://www.flink-forward.org/privacy-policy, which governs all of the information you provide to us to register with the Event or during your attendance and participation of the Event, each may be updated by Ververica from time to time.

Payment Information & Terms

Full payment of the Event registration fee must be provided upon submission of the registration form. Full payment must be received by Ververica at time of purchase. If Ververica had not received the full payment prior to the Event, you may be charged the day-of rate prior to gaining access or entry to the Event.

Registration and Discount

It is your responsibility to confirm the price displayed at checkout is the price you expect and agree to pay prior to completing the purchase. Upon submission of a complete registration form, the purchase and rate paid are final. We are unable to adjust, return or refund any purchased tickets for any reason, except as stated in our "Cancellations/Refund Policy" paragraph below.

Ververica may offer a discount code as part of a limited-time sale. This discount code may only be applied towards the designated type of individual or group registration, and the discount code can neither be transferred nor applied to another individual or group. Ververica honors only one discount code per ticket per Event. Discount codes cannot be applied retroactively.

Upon submission of registration, you will receive a confirmation of the registration via email. Additional rules may apply at the physical Event venue.

Cancellations/Refund Policy

Refund of the Event ticket is permitted as follows:

• We will make a full refund to you if the refund request is made on or before 11:59 9th October 2024 CET, and
• You will not be entitled to any refund if the refund request is made after 11:59 9th October 2024 CET.

You may transfer your ticket to your nominated person in accordance with the "Ticket Transfers" paragraph below.

If you wish to make a refund, please contact us in writing at hello@flink-forward.org. If you are qualified for a refund, the amount refunded will be based on the actual fees paid for the cancelled registration(s) and will be returned to you by via your original payment method.

Ticket Transfers

You may transfer your ticket which is purchased from us at any time, as long as:

• the ticket is being transferred to another individual, and
• we are informed in writing by email at least 5 calendar days before the Event. The new individual needs to register to the conference with a complimentary pass.

To request a ticket transfer, please email hello@flink-forward.org with a copy of your ticket number or email confirmation, along with the new attendee’s name, email, title, company, and phone number. You must show that:

• you are the original registrant or authorized by the original registrant to make changes to the registration and,
• you are authorized by the new attendee to provide their details to us for this purpose.

Changes to Agenda and Event

Whilst we will use our best endeavours to ensure the Event will encompass the confirmed speakers and agenda as of the time of publication, you acknowledge that there may be substitutions, alterations or cancellations of the speakers or agenda from time to time. We cannot and do not guarantee any specific speaker, performing artist, entertainment or other components of the Event agenda, and we will not refund any registration fees as a result of any changes to the speakers and agenda of the Event. Ververica will take reasonable efforts to publish any updates or changes to the Event on its website as soon as reasonably possible.

Our Liability to You

Ververica is not responsible for any damage or loss as a result of alteration, substitution, delay, postponement, rescheduling or cancellation of an Event. Ververica will not be considered in breach of these Event Terms or otherwise liable to you, except as specifically provided in this provision, if an Event is delayed, cancelled, rescheduled or postponed, in whole or in part, as a result of government-ordered closures of venues, services, and other spaces, government-issued shelter-in-place and quarantine orders, government and agency restrictions and recommendations place on individuals and groups of individuals, any law or action taken by a government or public authority, health and travel restrictions, floods, fires, wars, epidemics and pandemics, illness, accidents, internet and third party application connectivity, interruption or failure of utility service, electronic or communications failure, war, explosion, fire, flood, drought, earthquake or other natural disaster, terrorist attack, riots, civil war, loss of electricity, labour or trade dispute, strike, industrial action or lockout, non-performance by service providers and subcontractors, delays by you, and other impediments to performance caused directly or indirectly by any event or circumstances outside Ververica’s reasonable control, that make Ververica’s performance illegal, impossible, inadvisable or commercially impractical as determined in Ververica’s reasonable discretion. If an Event is delayed, cancelled, rescheduled or postponed for these or any other reasons, your sole remedy shall be that we will provide you with access to the rescheduled Event or a similar replacement Event, at a later date to be determined by Ververica. Ververica will take reasonable efforts to notify you of any interruptions to the Event as soon as reasonably possible.

To the fullest extent permitted by law, in no event will Ververica be liable for, whether in contract, tort (including negligence), strict liability:

• any indirect, incidental, special, consequential, punitive or exemplary damages or damages for loss of profits, revenue or data (in each case whether direct or indirect),
• any damage or loss to your properties or materials, and any personal injuries, arising out of or in connection with the Event and these Event Terms, including without limitation your registration process and/ or attendance to the Event.

Ververica’s liability for damages arising out of or in connection with these Event Terms or your attendance or participation of the Event will in no event exceed the amount of actual registration fees received by Ververica from you for this Event.

Notwithstanding the above, nothing in these Event Terms shall exclude either party’s liability for death or personal injury caused by its gross negligence, fraud or anything else that cannot be limited or excluded by law.

All exclusions and limitations of liability set out in this section (Our Liability to You) also apply to Ververica’s affiliates, members of the executive board, directors, employees, agents, subcontractors, sub-suppliers and other persons assisting Ververica. The views expressed by any Event attendee, speaker, exhibitor or sponsor are not necessarily those of Ververica or its affiliates.

Authorization for Recordings

Ververica, event sponsors, and other authorized third parties may from time to time take photos and videos at the Event, which Ververica and those third parties may later use in any format or medium for promotional purposes or which may otherwise be used, published or posted by a third party, including without limitation, via online posting on a third party or Ververica/Flink Forward website.

By participating or attending the Event, you agree that you may appear in these photos and videos, and authorizes, and agree to hold Ververica harmless from, their use in this fashion. You understand that we will hold and process your information in accordance with our Privacy Policy.

Special Assistance and Visa

You are responsible for advising us regarding any special access, accommodations or other assistance you require at the time you register for our Event, and we will assist you as best as we can. In the event your attendance at our Event requires the granting of a visa, you agree Ververica is not responsible for ensuring the granting of your visa and will not issue a refund if your visa is not granted.

Intellectual Property

The content and information available on or contained in the Event registration page and during the Event (including, but not limited to, data, information, text, music, sound, photos, graphics, videos, maps, icons, illustrations, logos or other material) are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Ververica or by third parties who have licensed or provided their material to us.

You agree not to, without our written consent, promote, create organise, conduct or otherwise hold any onsite or offsite events, activities, functions or general gatherings that will in any way be associated with us, this Event and/or our names and branding including but not limited to "Flink Forward Berlin 2024" and "Flink Forward".

Governing Law and Dispute Resolution

These Event Terms shall be governed by and construed in accordance with the laws of Germany. Each party hereby irrevocably consents to submit to the exclusive jurisdiction of the courts in Berlin, Germany for any actions or proceedings arising out of or relating to these Event Terms and waive any objection it may now or hereafter have to venue or convenience of forum.
